Terms of sale and website use — updated: 1 October 2026

1. Seller and scope

The seller is Julien Gimfeld, a sole trader operating under the Jul & Myra brand, Rue Émile Yung 11, 1205 Geneva, Switzerland. Contact: julandmyra@gmail.com. Telephone: +41 22 335 92 87.

These terms apply to purchases on julandmyra.com and use of the website. The version applicable to an order is the one disclosed to the customer when placing it. Mandatory consumer protections prevail over any conflicting term. Subsequent changes do not alter commitments made for an existing order.

2. Products

Product pages state the characteristics, dimensions, materials, variants, prices and availability. Please check the print size, framing option and any pre-order status. A frame is included only if the purchased variant expressly includes one.

Minor colour differences may result from the display device or printing process; this does not allow delivery of a product that differs substantially from the agreed characteristics. Purchasing a print or any other product does not transfer any reproduction or exploitation rights in the artwork.

3. Prices, taxes and payment

Swiss VAT: Jul & Myra is exempt from registration for Swiss VAT and does not charge Swiss VAT.

This status does not remove any tax obligations in other countries or import taxes and customs duties applicable to the order.

The applicable amount and currency are those displayed in the order summary before payment. Taxes that we are legally required to collect are included or disclosed before the order is confirmed. Shipping and any other charges invoiced by Jul & Myra are disclosed before purchase. No additional charge is added to an accepted order without a legal basis or the customer's agreement.

Any import taxes, customs duties and currency conversion charges imposed by the customer's bank are separate; import information appears in our shipping policy. We do not guarantee that these charges will be waived.

The available payment methods are those offered at checkout. Payment may be required when placing an order, including a pre-order, as shown in the order summary. Payments are processed by the relevant providers; we do not retain full card numbers processed directly by those providers.

4. Orders and availability

The customer selects products, checks the basket, contact details, delivery and total, and corrects any errors before confirming an order with an obligation to pay. An electronic confirmation is sent to the email address provided. Customers must provide accurate information and be authorised to use their payment method.

An obvious error, declined payment, fraudulent order or objective inability to supply a product may require verification or the remedies available under applicable law. We inform the customer and refund amounts due if the order cannot be fulfilled. We do not substitute a product or change its price without agreement.

Pre-orders follow the period announced on their product page, currently early January 2027 for the relevant new-collection items. Availability to order does not mean immediate availability for dispatch. Any postponement is handled under our shipping policy and the customer's legal rights.

5. Delivery and returns

Destinations, charges, preparation, tracking, receipt, importation and remedies for delays are described in the shipping policy, which forms part of the terms of sale.

Return conditions, statutory withdrawal rights, exceptions, refund costs and timescales, and the withdrawal form are set out in the return and refund policy. There is no general voluntary change-of-mind return right for purchases governed solely by Swiss law unless we make a specific commitment. Mandatory rights applicable elsewhere, including withdrawal rights for consumers protected by European or UK law, are preserved.

6. Statutory warranties

The seller is responsible for defects and lack of conformity under applicable law. Send a claim to Julien Gimfeld — Jul & Myra at the postal or email address in section 1, identifying the product and defect. Proof of purchase may be requested; it need not consist exclusively of an original receipt.

For contracts governed by Swiss law, the statutory limitation period for new goods is generally two years from delivery. Customers must inspect the product and report detected defects without delay, including hidden defects when discovered. To the extent permitted by Swiss law, we may first offer repair or replacement free of charge within a reasonable time. If this is impossible or unsuccessful, other applicable remedies remain available. No additional commercial warranty is provided unless expressly promised.

For consumers protected by European Union law, the statutory conformity guarantee applies for at least two years from receipt, without prejudice to more favourable national rules. Mandatory rights of customers in other countries remain fully applicable.

Mandatory notice for consumers protected by French law

The official French-language statutory notice is reproduced below. It describes the two-year conformity guarantee, repair or replacement within 30 days without charge or major inconvenience, applicable extensions, price reduction or termination remedies, and the separate latent-defect guarantee.

Le consommateur dispose d'un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d'apparition d'un défaut de conformité. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité et non la date d'apparition de celui-ci.

Lorsque le contrat de vente du bien prévoit la fourniture d'un contenu numérique ou d'un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n'est tenu d'établir que l'existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d'apparition de celui-ci.

La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.

La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.

Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d'une extension de six mois de la garantie initiale.

Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.

Le consommateur peut obtenir une réduction du prix d'achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :

  1. Le professionnel refuse de réparer ou de remplacer le bien ;
  2. La réparation ou le remplacement du bien intervient après un délai de trente jours ;
  3. La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;
  4. La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.

Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.

Le consommateur n'a pas droit à la résolution de la vente si le défaut de conformité est mineur.

Toute période d'immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu'à la délivrance du bien remis en état.

Les droits mentionnés ci-dessus résultent de l'application des articles L. 217-1 à L. 217-32 du code de la consommation.

Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d'un montant maximal de 300 000 euros, qui peut être porté jusqu'à 10 % du chiffre d'affaires moyen annuel (article L. 241-5 du code de la consommation).

Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien.

7. Liability and exceptional events

We are responsible for our obligations as required by law. We are not responsible for damage caused exclusively by abnormal product use or the customer's breach. No term excludes liability for intentional wrongdoing, gross negligence, death or personal injury, or any mandatory liability or warranty.

For business customers only and to the extent permitted by law, compensation for indirect losses, including lost profit or business interruption, is excluded, and liability for minor negligence is limited to the price of the affected product. This limitation does not apply to obligations or liabilities that cannot legally be limited.

An event reasonably beyond our control excuses performance only under the conditions recognised by applicable law. We take reasonable steps to limit its consequences and inform the customer. Statutory termination and refund rights remain available; the involvement of a carrier, Shopify or a workshop does not automatically release us from our obligations as seller.

8. Website use and shopping assistants

Disrupting the website, bypassing its security controls or using its content in breach of intellectual property rights is prohibited. Indexing and automated shopping services authorised by the store or its platform may be used within their intended scope.

An order placed through a shopping assistant authorised by the customer is subject to the same price information, terms and rights as a direct order. The assistant must act within the authority given by the customer. No purchase is authorised without the customer's required consent.

9. Personal data

Data processing and cookie choices are described in our privacy policy. Acceptance of the terms of sale does not constitute consent to advertising cookies or marketing where separate consent is required.

10. Governing law and disputes

Swiss law applies subject to private international law rules and mandatory consumer protections, including those of the customer's country of residence when their conditions of application are met. No consumer is deprived of competent courts or remedies granted by law.

For contracts between businesses only, and unless mandatory jurisdiction rules provide otherwise, the courts of Geneva have jurisdiction. For complaints, first contact julandmyra@gmail.com to seek an amicable solution; this does not constitute a waiver of, or obstacle to, legal remedies.

If a term is unenforceable, the relevant legal rules apply and the remaining terms continue to the extent permitted by law.
